The following terms and conditions represent the basis upon which driving lessons and courses are offered by the Alex School of Motoring
General Conduct: Your Instructor
Your instructor (Alex Hughes or Edward Hughes) is bound by a professional code of conduct. We will be courteous, polite, tidy and punctual. We will also behave in a professional and ethical manner at all times. The vehicles will be well maintained, clean and tidy. The vehicle you drive will be fitted with dual controls as part of its standard equipment. It will be fully insured for driving tuition. During your lesson we will not undertake any other form of business, professional or otherwise.
General Conduct: You (The Student)
You will be courteous, polite, tidy and punctual. You will also behave in an appropriate manner at all times. You will not smoke in the vehicle. Our vehicles are our workplace, as such it is unlawful to smoke within the vehicle. You will follow the instructions given to you at ALL times and undertake to complete agreed work to assist you in passing all parts of the Driving Test
We are licensed by the DVSA (Driving Vehicle Standards Agency) to give driving tuition. (Registration number, Alex Hughes – 449823, Edward Hughes - 548854)
Driving Licence and Eyesight
You must hold a current UK, valid driving licence (provisional or full), which must be produced on or in advance of your first lesson. You must also demonstrate that you are able to read a car registration plate at a distance of 20.6 metres (67 feet or about 5 car lengths) with glasses or contact lenses if normally worn. If you cannot comply with these requirements instruction will NOT be given.
Please note payments must be made in advance of training direct to your instructor. Payment by cash electronic transfer or cheque are acceptable. Cheques should be made payable to Mr D A Hughes or Mr E B Hughes as appropriate. Where a block booking has been made; if you pass your test before using all lessons a refund will be available at the equivalent hourly rate. Alternatively funds can be put towards Pass Plus. Pass Plus lessons incur a higher cost due to higher anticipated mileage.
A minimum 48 hours notice is required if you wish to postpone/cancel a lesson. In the event you fail to give 48 hrs notice, We will make every effort to resell that lesson time. In the event it cannot be resold, we reserve the right to charge for any lessons postponed or cancelled.
We reserve the right to postpone lessons if we feel that the weather or road conditions are unsuitable or dangerous. We cannot be held responsible for any costs incurred as a result of having to postpone lessons for whatever reason.
In your own interests you are advised to be punctual for your lesson appointments. Your appointments will be recorded in your appointment card to ensure mistakes are avoided. Your instructor will wait for a maximum of 15 minutes before abandoning a lesson, at which point the lesson fee will be forfeited. A reciprocal waiting time may become necessary if your instructor is delayed due to unforeseen circumstances. In these circumstances any lesson time lost as a result of this will be made up either at the end of the normal lesson time if possible or at a later date by agreement.
Pupil Comfort and Safety
In the interests of comfort and safety; students are advised to wear suitable footwear and clothing, which does not restrict movement. Students must take note of any medication they are taking that may affect their ability to drive safely. If there is any risk medication might affect your ability to drive, you will advise your instructor before commencing instruction.
Instruction will NOT be given to any student who may be under the influence of drink or drugs. In such circumstances instruction fees will be forfeited
The Driving Test: Bookings
Driving tests can be booked by you or by your instructor on your behalf. Driving test bookings always take priority over other lessons. Therefore, your lesson may be postponed to allow for someone else’s driving test and vice-versa. Changes to lesson bookings as a result of this will be notified to you immediately. Likewise test appointments made by you must be notified to your instructor as soon as they are known; otherwise we will be unable to guarantee to provide a vehicle for the test.
The Driving Test: Use Of Vehicle
Use of the vehicle for the duration of the test, travel and waiting time will be charged at the usual rate. In the interests of customer and public safety; we reserve the absolute right to withhold the use of a vehicle for the test, if in our opinion, your driving is actually or potentially dangerous, you are insufficiently prepared to take the test, or we believe that you will in any way bring the name of the Alex School of Motoring or yourself into disrepute
The Driving Test: Test Cancellation
Three clear working days notice of cancellation or postponement is required by the DVSA. Failure to provide the required notice will result in the loss of your test fee. We cannot be held responsible for any postponement or cancellation of tests by the DVSA and in these circumstances the lesson fee is still payable. However, we will do all that is possible to assist in arranging another test as quickly as possible and to help you reclaim expenses from the DVSA.
The Driving Test: Test Failure
In the event of test failure; a minimum of 4 hours further training (including pre-test lesson) must be taken before another test can be attempted in our vehicles.
At various times we may be required by the DVSA to undertake a check test. Your instructor will be required to undergo the test with a pupil at a DVSA Test Centre. Should you be required for any such test, it will not be detrimental to your lesson. In appreciation of assisting us, should the occasion arise, then the lesson will be charged at 50% of the usual rate
In the event you are in anyway dissatisfied with the service we provide; please discuss with your instructor in the first instance to seek resolution. In the unlikely event you cannot resolve the issue please make contact with our alternative instructor who will review the issue as soon as possible.
Your Statutory Rights
Nothing in these terms and conditions will reduce your statutory rights relating to faulty or misdescribed goods or services provided. We have a statutory obligation to provide you with goods and services fit for the purpose for which they were bought and as described. If you have any doubts about your statutory rights please contact your local Trading Standards Department or Citizens Advice Bureau.
When bookng with Alex School of Motoring, You declare that you have read and understand the above as set out in the terms and conditions. You agree that you have made a contract with the instructor in accordance with them.
